How to Build a Compliant AI Use Policy for Your Brokerage

A written AI use policy is no longer optional. The NAR recommends that every brokerage create one, and several state commissions are moving toward making formal AI policies a licensing requirement.

6. Incident response. Define what constitutes an AI-related compliance incident — such as a chatbot exposing client data, an AI tool generating discriminatory content, or a data breach at an AI vendor — and outline the response process, including who to notify and within what timeframe.

7. Training requirements. Require all agents and staff to complete AI compliance training before using any AI tools, with annual refresher training thereafter. Document completion dates for each team member.
